Home Depot Distribution Center Employees File a Wage and Hour Class Action Against Home Depot.

On May 24, 2019, a group of California distribution center employees filed a wage and hour class action lawsuit against Home Depot earlier this year.  The lawsuit is pending before the United States District Court for the Eastern District of California.  The Plaintiffs are represented by the California employment law attorneys at the JCL Law Firm, APC and Zakay Law Group, APC.

The complaint alleges that Home Depot failed to accurately pay its distribution center employees the correct overtime rates in pay periods where the employees worked overtime and earned non-discretionary bonuses. The complaint also alleges that the distribution center employees were denied a second meal period on shifts exceeding 10 hours. Finally, the complaint alleges that Home Depot issued wages statements that did not accurately set for the applicable hourly rates for in effect during the pay period and the corresponding number of hours worked at each hourly rate.
